ROA FOR CHILD BORN ABROAD

Post by Akhan88 » Sun Oct 20, 2024 8:05 am

Hi

I have applied for divorce in the UK but got married in Pakistan while waiting for divorce. I haven't registered the wedding in Pakistan and my wife is pregnant so once I get the divorce I can register wedding in Pakistan can I register my child straight after the registration of wedding in Pakistan? Like let's say a month after ? I'm going to be applying spouse visa for the wife and Right of Abode for the child. I'm already British Citizen so will my child be considered for ROA or will it be a dependant of the mum who is Pakistani Citizen?

Please someone clarify this for me ?

Regards

If you were British at the time child was born then child is already British and can apply for the right of abode certificate- it’s not a visa. Child needs a foreign passport into which ROA is fixed.
British citizen can’t apply for a UK visa.

Thanks for clarifying that I'm already British and child js expected Dec 2024. Also my 2nd question was if there isn't 8 9 months gap between married and registering child is that OK or will it make any problem ?

The birth of the child should be registered as soon as possible. A delayed registration of the birth may cause issues.

Even children born abroad outside of marriage can inherit British citizenship from their British citizen father.

For a spouse visa, the date of the second marriage should be on or after the date of the decree absolute of the first marriage.
