Applying earlier than eligible date

Post by hputra » Thu Nov 07, 2024 1:26 pm

I am currently on GTV, and my current visa expiry date is on 01 March 2025. If I count correctly, I will be eligible to apply for ILR Set (O) on 31 January 2025. I am very anxious by looking at the availability of TLScontact appointment. I do understand that the case worker can count the continuous residence periods based on:
a) the date of application
b) any date up to 28 days after the of application
c) the date of decision
d) for a person applying for settlement on the UK Ancestry route, the date of their last grant of permission

I am thinking to submit my application before 31 January 2025, and book for biometric appointment after the date of eligibility. My question is, has anyone tried it and was the application successful?

Hey,

I recently did this, but attending my biometrics next week. Plenty of people has done this before, and check the pinned topic here about applying early.

Anyway, I should be able to provide an update next week or the week after as I applied for Priority.

About TLS contact appointments, I had the same concerns and they were proved right when I tried to book one, the earliest I could get was a month away. But I got a cancellation, 2 days after my eligibility date, all the way in Belfast

Hi @zimba Thank you for your reply, and I am fully aware of the immigration rules underlying it. I am just looking for anyone experience of using it. It is mainly just the anxiety I have over it.

@MasterZap, I am looking forward to hear your experience. Just out of curiosity, what date did you submit your application and when was your eligibility date?

The immigration system is not experience-based. If you stick to the rules you will be fine, so there is no need to be anxious. This advice has successfully been given to hundreds before you.

My eligibility date is 09/11/2024 (28 days before the tier 2 visa sticker issue date) and I submitted 25/10/2024.

Hi Zimba, just for clarification. I switched from partner visa to GTV fast-track on February 2022. My GTV issue date and start date was 01/03/2022. If my calculation is correct, my eligibility date is on 31/01/2025. So if my understanding is correct, I can submit my application early and book the appointment at TLScontact after 31/01/2025. So is this planning correct?

Hey @hputra, are you sure you can combine the time spent on the partner visa with the GTV visa? I believe if you switch from certain visas the clock is reset

Edit: Ahh my bad, I guess you have the 3 year ILR residency requirement on the GTV?

Yeah, it is the 3-years route one.

Correct
Hi Zimba, I am starting to fill the application for SET(O) - GTV. I have a few questions for you:
1. When I looked at my previous GTV application, I made a mistake in which I answered "no" for the question "In addition to the names already provided, are you now or have you ever been known by another name?"
I use my marriage surname for my UK driving license. However, both my passport and BRP are using my maiden surname. Would it cause any issues for my ILR application if I answered it as "yes" that I have been known my other name.

2.Related to "Enter any Home Office reference numbers", I have a reference no from Home Office Atlas when I received my GTV, is it the number started with 1212-xxxx-xxxx-xxxx? or is it a different no?

Thank you very much for your assistance.

1. No issues. You can use either name legally in the UK without any issues
2. Leave it empty
