Hi all, not sure if anyone can help but thought I'd ask anyway.

I am married to an EU national and currently on a UK Graduate visa. My husband is extremely emotionally and mentally abusive towards me and has been ever since wr got married. I kept forgiving and thought he might change but its been 11 months and the situation has got worse. He keeps track of my spending, I can't even go out and eat without him pointing it out and questioning me. I can't even go to my sister's house without him having issues. He swears at me and calls me names and has threatened me with divorce so many times throughout the past year. Him and his family are forcing me to have kids as well. He's now saying that he won't sponsor my spouse visa anymore, all out of pettiness. I have applied for the spouse visa two weeks ago and now I don't know what to do as I wanna leave him but then how would I stay in the country. I moved here 3 years ago and have a job and a life and leaving all this isn't an option for me. I'm really scared and absolutely desperate for help. I've reported this to my GP and also to the national domestic abuse helpline but no one's been able to help me with my immigration situation.

I was wondering if there's any way I could stay in the country? Maybe be eligible for MVDAC or ILR through the domestic abuse route? I know you have to be on a partner/spouse visa for these but since I don't have that yet, I'm not sure what to do

I believe you do not have much options as your visa does not allow you to go to DV ILR. You can look for the work permit if you want to stay in this country. Even if you get your spouse visa which is under process you can not apply after that for DV ILR you need to wait more than 6 to 12 months etc .. you need all new evidence etc ...

No ask for further documents still waiting more than 6 months now.
I am in the same boat applied on 9th July until now no contact or response it seems like 9th Jan 2025 will be six month for me as well. during that no communication at all. but my case looks little weak as I have no Domestic violence in my last extension the last incident was happened 3 years ago. In my last extension it was more control related and threaten me verbally will not apply my ILR. other than that some 3 years old police reports but not charged. GP report also not saying any thing about violence. but all from before my last extension. Also I have 18+ years of son applied with my application and I have read at many places if you are applying with a chid under or over 18 with your application you need to prove that you can support him without using the public funds which I can not as I am on benefits(Using refuge and getting money from council ) .

As I am not working destitute not paid for my application, :( chances of my case are very slim. even if they give me ILR still chances for my son is nearly impossible as he is 18+ and is not working and we do not have funds to support him also I have a daughter as well but she is British but still I have to prove I can support both without use of public funds ... I can understand why my case is slow and no response.

What is your case do you have (police, GP, MARAC, etc ).

I need some guidline
My friend came in UK on spouse visa and than applied dv ilr during application processing time if ex partner dies so it's affect the dv ilr application.
Because last extension on his dependent spouse visa

Please reply if anyone knows.

As far as I know it should not have any effect on the application because you are still a victum of abuse and your case was field before his death. Also if the abuser died it does not mean that the abuase was not happened etc.

So once you start living separate from you ex. Your relationship with him was ended now if he died / marraid again etc will not effect your current application.

Hi All,

After 5 months and 20 days I recieve an email from home office asking futher documents ( police report, gp report. Prove sole responsibility of my son and financial details how I will support my son.

I already provided police references , 1 GP report and letter from socail worker, But I do not know how to prove sole responsibility... if anyone know please help me. For the maintenance I am going to send my benifits details which I am claiming ... they want me to prove 264£ or more per week for my son any help plz let me know ...

Hi All, Some one told me that I have to show adequate maintenance for my Son who applied with me on my DV ILR application. Does anyone know can I use Universal Credit , child benefits and Housing benefits as my source of income ? Or it is only for those who are getting following benefit's

Carer’s Allowance;
Disability Living Allowance;
Industrial Injuries Disablement Benefit;
Severe Disablement Allowance;
Personal Independence Payment;
Attendance Allowance;
Constant Attendance Allowance;
Mobility Supplement;
War Disablement Pension under the War Pensions Scheme;
Armed Forces Independence Payment;
Guaranteed Income Payment under the Armed Forces Compensation Scheme;
Policy Injury pension;
Child Disability Payment; or
Adult Disability Payment.

??

Or I can use as well ? Or I have to show proper income to support my SON? I mean job earning at least 29K a year ? is there any exception for domestic violence victim if they want to apply for children or not ?

Finally Got ILR approved for me and my SON. I was long wait and I was hopeless because of my weak case but today I recieved an email of approval. For my son I wrote a detail reply saying to them he is in full time education his sister is british and he has no one back home and it will be not in best intrest of him to has his ilr refused. After 1 day I recieved mine and his both visa approved.

So do not worry every one it seems like one of the easy path to get ILR with high success rate.

ILR BIOMETRIC:Oct 10TH 2024
ADDITIONAL DOCUMENTS:December 10th 2024
APPROVAL EMAIL:17TH JAN 2025

I came in December 2022 on a COS
Got married Jan 2024
Got Spousal visa March 2024
Abuse and abandonment started.

No matter the route with which you come into the country,it doesn’t matter how long you’ve been in the uk on a spousa visa,I stayed on a spousal visa for only 3 months,and I have been in the uk for just 2 years.Mind you no child.

Hi, posting my timeline and documents submitted if it helps anyone:

Date of application submission: 14/10/2024
Date of biometrics: 01/11/2024 (free, London Croydon)
Additional documents requested: n/a
Approval received: 24/12/2024
BRP: n/a, e-visa

Documents submitted:
Police report (you can get it even if you have ongoing investigation, a bit of a process)
GP letter
DV organisation letter
Psychiatrist report
Personal statement (16 pages with dates)
Letter from a relative with translation
Letter from solicitor with case law examples (highly recommend using an immigration lawyer if you can)
Other basics (marriage certificate, payslips etc)

Some details on my immigration history:
Came to the UK in 2013 on a student visa, was on Spouse visa since 11/2019 with an extension in 2022. I did not apply for concession, benefits or fee waivers.

I didn’t do fee waiver.I would advise whoever not to go for fee waiver.My time frame is 3 months.My total stay in the uk
2 years.
