Advice on Visa Extension and Medical Treatment Challenges as an Expiring Student Visa Holder

Post by JustARandomHuman » Mon Jan 06, 2025 11:21 am

Hello and Good day everyone,

I hope you're well. I get some help on my situation as it is a bit complex. I am currently on a student visa Early this year, I had a work related accident that resulted in me not being able to submit my dissertation as at when I was supposed to. This accident required surgery, therapy and hospitalisation for 8+ weeks.

My school extended my submission date to within 15 days of my student visa expiring, making me ineligible for the graduate visa application. This student visa will expire at the end of this month.

I am still recovering from my surgery and recently I have had new pain in the area where the surgery occurred. This pain can get so intense that it hampers my ability to walk. When I spoke with my GP and received x-rays, it appears that a metal fixture that was put in my leg had snapped and was causing this significant pain.

My GP recommended that we pick up my situation following Christmas but it is clear that corrective procedures will need to be taken to address the broken metal in my leg causing me significant pain. I've spoken to doctors back home and they advise that I finish the course of treatment before transferring my current medical situation unresolved.

So I have a few questions

Is there anything I can do to ensure that I can stay in the UK to resolve this medical situation? I have seen people mention that I can file for an extension of my student visa in some capacity but I am not sure.

If I am able to prove, with scans and written letter from my GP that I need this access, and subsequently get the extension, would I still be eligible for the graduate visa? It was this surgery that originally made me miss my submission date for my dissertation.

My case is an irregular one, do you have any recommendations for any solicitors that would be able to assist me?

Any help is appreciated. Thank you.

It is worth adding that I have reached out to my university about the situation.

The university initially told me to finish up my dissertation as quick as possible, and then they would see what could be done.

After managing to do this in December, a month and a half ahead of the submission date, the university has now refused to issue an extension or offer help in any way. They've refused to convene the board earlier so that my first submission can be reviewed quickly.

Subsequent discussions with university staff informed me that at the point of first contact I should have informed the university that I would not be able to complete the work in due time due to my injury. Sadly, this is in hindsight, and it appears that some people at the university have successfully manipulated me into a weaker position.

I informed every step of the way of my medical situation as well.

No. You can only extend your Student visa only if you university agrees to support the application by issuing a CAS, which they have said they will not be doing.

Only if you are genuinely physically unable to leave the UK when your Student visa expires, speak to an immigration legal adviser about making an application outside the immigration rules.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

You cannot recommend solicitors on here. We're all strangers.
