Inequivalent SOC code used for ILR Application

Hi all,

I'm going to apply ILR but got confused about the SOC in company letter.

I'm a skilled worker under code 2431, but the code has been changed in SOC 2020.

My current visa expiring in few month and the company has discussed with solicitor that all my future sponsorship will be under code 3120, which is matching my job description. I understand it as the code for my new CoS.

However, now I'm applying for ILR, the company letter states that "the future sponsorship will be under code 3120". I'm confused if I can still use this code as it is inequivalent to the original code.

May I confirm if the inequivalent code is also ok to use in ILR application as long as it matches the job description with my current CoS?

Please help. Thank you.

The code does not matter itself. What matters is the salary calculations based on the new code.

The Standard Occupational Classification (SOC) codes assigned to each role have been simply updated by the UKVI from the 2010 codes to the 2020 codes, so both the old SOC and the new 2020 SOC should effectively refer to the same role. You should use the new 2020 SOC to determine your salary requirement for ILR.

Sorry I'm still feeling confused, cuz the salary requirement is determined by code.

According to Table 2, there are 5 equivalent code to 2431 and have different salary requirement, but the code 3120 in the letter is not one of the equivalent ones. Thus, I'm not clear if 3120 considered to meet "both the old SOC and the new 2020 SOC should effectively refer to the same role".
