Child born outside of UK and Spouse Visa

Post by Wayfarer777 » Sat Jan 18, 2025 9:05 pm

Hi everyone,

I would like bring my wife and my child (1 year) to UK. I am a British Citizen by naturalisation, and my child was born in India. By the time my child was born, I was already a British Citizen. Could someone please guide me what is the best route to apply from the below options.

Option 1:
Apply British Passport for my child first, and then apply spouse visa for my wife.
Q: How long does the process taking now?

Option 2:
Apply India Passport for my child and then apply for CoE-RoA, and then apply spouse visa for my wife.
Q:Is this a better option than applying British passport directly for my child considering the timelines?

Spouse visa:
As far as I remember, there was a rule that once spouse visa is approved, spouse should travel to the UK within 30 days and then collect the BRP card in the UK. Is that rule still in place? If not, what is the window period for spouse to travel to UK once spouse visa is approved?

Your answers will be greatly appreciated.

Thank you.

Hi Moderators,
Did I post in wrong section? Is this post should be in non-tier British Passport section?

Nationality and passport topics should be posted in the "British Citizenship" forum (https://www.immigrationboards.com/viewforum.php?f=42).

Regarding 1 - First child passport applications from India could take quite a few months, six months is quoted frequently.
Regarding 2 - ROA website (https://www.gov.uk/right-of-abode/apply ... ntitlement) suggests an 8 weeks turn around, not aware of current timings, however it would make sense compared to potential waiting time for passport. Not aware how long an Indian passport takes. Once in the UK child can apply for British passport.

BRPs are no longer issued - it's all digital immigration now, on eVisa - I would expect new applicants from abroad will get guidance on how this works.

Sort out your child first and then you can start processing your spouse. You wouldn't like your child to delay entry for your spouse.
No sin in failing, you just have to try and try again!

Thanks for your suggestion. I thought the same as well. I will apply CoE-RoA for my child first. Once we got that, I will then apply spouse visa for my wife.

Once question here - Not sure whether we have any section in spouse visa application form to mention dependent details. Should I need to mention my child as dependent in the spouse visa application form even though we are making separate applications for my child and wife?

Your child is a British citizen, she cannot be a visa-dependent. Once child has a COE-ROE or a British passport she can enter the UK without any hindrance or dependence on mother's spouse visa.
