Spouse visa extension as a result of ILR rejection

Hello All,

Seeking your experience/insights on a question I had.

The situation:
I'm up for my ILR via spouse route in Mar'25. But my continuous residency was impacted in the year 2020 due to Covid. I've overstayed the 180 day threshold by 85 days due to travel restrictions in place between India and the UK. I've read answers to questions around overstay in some other threads and do understand that amnesty is at the discretion of the Home Office.

My question:
Should the ILR be rejected due to the continuous residency parameter, would the application for ILR be automatically converted into a visa extension within the ILR fee or would I be required to file a new application with additional fees for the extension over and above the fee paid for the ILR application?

Has anyone seen any precedents or have insights?

No. If you apply for ILR and you do not qualify, the application will be refused. An extension needs its own separate application using a separate form
