Applying Based on Spouse with leave to remain or as a step-parent to a British child

Hi Everyone,

I would like some help regarding my husband’s application.

Background
He came into the country on a student visa and we met and got married(civil ceremony)here in the UK. For me, I have limited to leave to remain on the basis of my British child(10 year parent route).

My child’s father is an absent father and I have made this known in recent applications. My husband has since filled in the shoes of a father and has a beautiful relationship with my child. He attends Parent teacher meetings, picks him up from school as I majorly handle drop off etc

I have the following questions:
- Can he apply on the basis of being my husband, seeing as I only have limited leave to remain?
- If yes, what type of visa should he apply for? What’s the name?
- Seeing as he has an amazing relationship with my child, can he apply on the basis of being a stepparent to my child?
- If yes, will this be the same parent visa application I make as well?
- What documents can he submit to prove his relationship with my child? We’ll be getting the following: letter from school, letter from GP as we’re all registered at the same gp, letter from me(wife)
- If applying on my basis, do I need to fill the declaration form for spouses?
- What other supporting documents can we provide?

I’d like to understand which approach will be better:
Spouse of someone with limited leave to remain or As the step-parent of a British child where other parent(father) is absent in child’s life and applicant is very much involved in child’s life.

I’d love to hear from who have taken either of these 2 routes

Others might advise differently, but your husband can't be a dependant to a dependant!

You're dependant on your son, so you're not fully grounded either.

He's not the biological father, so he can't attach to your son as well. He'll need to find his own pathway.
No sin in failing, you just have to try and try again!

Just leaving an update here.
So my husband was granted limited leave to remain under partner route, although he was put on 10 years, not 5 years because I also have limited leave to remain as well.

We are very happy and excited about this news
