Submitted ILR application without meeting eligibility criteria

Hello,

I moved to the UK in March 2019 on PBS Dependent visa. I changed to Skilled Worker visa in October 2021. I have submitted an ILR application on 16th Feb 2025, counting both my time on Dependent visa & Skilled worker visa towards the 5 year eligibility. However, I just came to know that you cannot combine the time spent on these two visa categories. Considering that I have already paid the application fee as well as submitted my biometrics on 28th Feb 2025, is there any way I can get a refund of my application fee?

Also, I am suffering from some health issues and want to visit India for treatment, but cannot leave UK until I get a decision on my ILR. Any chance I can use health emergency as a reason to withdraw my ILR application with full refund?

You simply need to request withdrawal of your application. Note that the fees are not refunded as you already attended your biometrics appointment

Thank you for your reply. If the fees will not be refunded on withdrawal, is it better to allow the Home Office to provide a decision on the ILR, as I will lose the money in either case?
