is Childcare a public fund?

Post by Wandra » Tue Jan 21, 2025 4:25 pm

Hi,
I’m seeking clarification on whether applying for 15 hrs free childcare for our 2 year old, as a British citizen, would affect my husband indefinite leave application this November. He is currently on spouse visa with No recourse to Public fund.

Could you confirm if this benefit is classified as public fund and whether it might impact his application?

Thank you for your assistance.

Yes it is public funds as it's coming from the government. However, you as a Brit can claim it. So it would have no effect on your spouse future visa applications.
I know they'd ask for his details like NI, work details and all. But that's normal. You can claim this "public fund"!

It is not classified as a public fund, see eg this page from the official website for City of London https://www.london.gov.uk/programmes-st ... 669=221668

Thanks for shedding light on this. I missed the update. Nice work!

Hundreds of thousands of eligible working parents can now access 15 hours government-funded early education for children aged 9-months-old and older after new rules kicked in from 1 September 2024.

A quick note that the information above only applies in England, as the website states clearly.

Secondly, this is a pedantic note and not related to the question in the thread, but the website above is not that of the City of London. It is that of the Mayor of London, who governs Greater London. The Mayoralty and Greater London Assembly are only 25 years old (they came into existence in 2000).

The City of London, often just called the City (with a capital "C"), is the ancient Roman core of London. It is where many financial companies and the core financial institutions, such as the Bank of England and the London Stock Exchange, are located. Very few people reside there. And it is still governed by ancient (1000+ years old) institutions and guilds. The ceremonial head, elected annually, is the Lord Mayor of the City of London. Unusually, in spite of heading one of the most prestigious and richest local governments in the UK, the Lord Mayor is not paid a salary, but is required to finance their office out of their own pockets.

If any of you live in London, I would highly recommend a visit to the City, especially on Lord Mayor's Day (which is almost always the second Saturday in November), an ancient procession through the City of London for the new Lord Mayor to show himself to the people of the City.

As @contorted_svy is Italian (judging from the flag on their profile), the Italian equivalent would be if the Republican and Imperial Forums in Rome were their own Rione and were still administered by the ancient Roman Senate.

Entitlement to help with childcare under the 15 or 30 hours schemes are not public funds and you may be eligible subject to the eligibility requirements. Childcare costs under UC are a public fund, if you are entitled to public funds then you may be eligible for UC, subject to eligibility requirements and means testing.

Thank you. We are planning to submit our free child care application this week and would appreciate your guidance on the following:
1. In my husband’s ILR (Set M) application, there is a question asking whether either of us has ever claimed public funds, with “Child Benefit” listed as one of the options. Given that Child Benefit is not considered a public fund for ILR purposes, should we select “None” in response to this question?
2. Am I eligible to apply for this grant with only a conditional job offer, or is an unconditional job offer required?

Thank you in advance for your assistance. I look forward to your response.
