Indefinite leave to remain-spouse visa

Post by Dldlr » Sat Dec 28, 2024 5:19 pm

Hello
I would like some advice please on when I can apply for my ILR
I entered the UK on 28th December 2019 on a spouse visa, so today 28 December 2024 makes it exactly 5 years. My current visa (FLR-spouse) expires in April 2025.
Can I apply for ILR now since I have been living in the UK for 5 years or do I have to wait till 28 days before my current visa expires?
Many thanks for your help

Yes. You could've applied a tad bit earlier even.

Visa expiry is irrelevant for ILR. You are eligible within 28 days of completing your 5 years in the UK, counting from the date of the very first entry/switch

Spouse visa to ILR help!!!

Post by Dldlr » Mon Apr 14, 2025 1:02 pm

Hello
Thank you for all the hard work you do here - much appreciated :D
I am in the process of applying for ILR as my spouse visa expires in a couple of days and I had a few concerns
1. I currently earn £28000 a year but the financial requirement is now £29000- I guess I am still ok as I had applied in 2022 when the minimum salary was £18600. Is my understanding correct?
2. There is a question on whether myself or partner receive any benefit- my partner receives DLA for our son but I am not sure if this question relates to us or our children?
3. I drove more than the speed limit last year and I was asked to do a speed awareness course which I have mentioned on the application form. Just wondering if this will affect my application?

Thank you so much for your time. Looking forward to your reply.

1. Correct
2. You should declare all benefits you claim in the application
3. It has no effect

Thank you so much for your quick reply, perfectly understood
2. Oh I must have misunderstood this then as I thought the benefit only referred to me or my partner and not the children

Parents claim benefits on behalf of the children
