can I still apply for ILR from 2nd sponsor?

Post by Amazonali103 » Thu Apr 17, 2025 6:36 pm

My five years route under Tier2 is near to complete. I want to be well prepared. but wondering, my 7 months salary was due and never paid by 1st sponsor. Can I still apply for ILR under 5 years route? Currently I am employed by 2nd sponsor and have 5 years visa.

Can anybody advice on this?

You did not break the rules and conditions of your visa, so that is irrelevant for ILR

I'm curious because the previous sponsor did not pay me the salary and tax to Hmrc. So HO will.not ask me about the tax ?

There is no requirement for continuous employment or pay under the rules. Note that just because you are concerned about an issue does not make it necessarily a problem from the immigration perspective

Do you know someone in your circle who went through this scenario and got the ILR. If you know someone who was in the same boat, then can you please connect me with him?

The immigration system is NOT an 'experience based' system. It is a rule based system where you are subjected to the rules and procedures in place. Again, because you simply feel something to be a problem does not mean anything. People with gaps in their employment apply and are granted ILR regularly
