Can I be sponsored by my dad’s business for Skilled Worker visa?

Hello everyone,

I’m currently on a Post Study Work (PSW) visa and working part-time at my father's pub business (a Greene King pub). He is the director and is planning to sponsor me under the Skilled Worker visa route for a Bar Manager position.

I’ve been told by a solicitor that it’s not possible because my dad is the business owner. However, I’ve also read that it may be allowed as long as an independent Level 1 SMS User assigns the CoS and the role is genuine.

We are planning to appoint a non-family Level 1 SMS user and follow all the guidelines.

Can anyone please tell me if anyone has been in a similar situation and successfully received a visa?

Any advice or guidance would mean a lot.

It is better to be transparent with them and note the family link. Note that UKVI may seek evidence of the recruitment process and ask about how you know the sponsor on each stage.

You are landing yourself in hot water as they can enquire at every stage. (License application, visa application renewal every entry to the UK etc)
If I were the case worker I would see this as abuse of the route.
