Skiller Work ILR Set(O)- Earliest application date

Hi All,

My partner and I are applying for ILR via set(O). I am currently on the skilled worker visa, and my partner on the dependant visa.

I was just hoping to get some clarification on earliest application dates? As I believe we will need to rely on both the 28 day qualifying period mechanic, as well as delaying our biometrics (Section 3C) to meet the 5 year continuous period requirements.

Please see below key dates.

Tier 2/Skilled worker (and dependant) dates:
Visa approval Emails Date: 24/08/2020
BRP Issue Date: 22/10/2020
Current Visas Expiry Date: 28/06/2025

From reading many past posts I have gathered the below conclusions. It would be great to get some clarity on this for peace of mind, if that is at all possible!

Conclusions/questions to clarify:

- The qualifying time period can be counted starting from when the Visa Approval Email was received? If so that would make the earliest 'date of decision' 27/07/2025, being 24/08/2020 plus 5 years less 28 days.

- Via section 3C, we can submit our ILR applications prior to our visa expiry date of 28/06/2025, and delay biometrics appointment so that it is 27/07/2025 or later?
Such that the time period between 28/06/2025 (current visa expiry), and the decision date will count towards our qualifying period and that we are not staying illegally?

- Biometrics can be delayed by up to 45 working days after the ILR application date?

Apologies for the multiple questions! If anyone is able to consider the above to confirm/clarify these three points, that would be very much appreciated!
