Child benefits for kids on dependent visa when main applicant has ILR

Post by alialhoni » Sat Apr 19, 2025 5:42 am

Hi

Main applicant has ILR, based on skilled worker visa.
Kids are still on skilled worker dependent visa, and are not eligible for the ILR yet.

Can the main applicant, who has ILR, apply for child benefits for kids with skilled worker dependent visa?

Thanks

If a the child is subject to immigration control (ie - no recourse to public funds restriction) you claiming benefits due to their presence may breach their immigration restrictions. However, I’ve never seen a case in practice where this has been an issue for a child. It’s a choice you have to make as to whether you want to take a potential albeit unlikely risk.
