Naturalisation Eligibility for Children on ILE – Advice Needed

Post by springfields » Mon May 05, 2025 7:02 pm

Hello,

I would appreciate some guidance on the following situation:

Both parents were granted Indefinite Leave to Remain (ILR) in May 2013.

Child 1, born in the UK, obtained British Citizenship as a child.

The family moved to India for work with a UK-based company.

ILR for both parents lapsed during the pandemic.

Parents returned to the UK in 2022 on Returning Resident visas.

Child 2 (age 10) and Child 3 (age 7) were born in India and arrived in the UK 9 months ago on Indefinite Leave to Enter (ILE).

I would like to know:

When is the earliest I can apply for naturalisation for my two younger children?

What is the probability of a positive outcome if I apply for childern's naturalisation after 1 year to 2 year to 3 years residence in U.K

Are there any specific residence requirements for children in this case?

Will a short family visit to India next month (e.g., one month) affect their eligibility for naturalisation?

Thank you in advance for your help.

I believe in this scenario the child with ILE will only become eligible for naturalisation when parents gain ILR again. there is an expectation for children born outside the UK that parents must be settled.

A person readmitted as a returning resident will have their ILR restored. If there hasn’t been any recent changes.

Parents have gained ILE in 2022 through returning resident visa.

My doubt is, If children are born overseas to ILR parents, when can they apply for registration?
Children would be eligible for British Citizenship if they were born in U.K straightaway if they were born in U.K as both parents were ILR.

Now children and parents all have Indefinite Leave to Enter. Parents can apply for Naturalisation when they finish 5 year residency period in U.K.

You need to review this guidance https://www.gov.uk/government/publicati ... plications

As neither you or your wife are eligible to apply for naturalisation your child will need to complete 5 years of lawful residence in the UK to be eligible to apply.
