SWV Going Rate ILR

Apologies in advance, I know this may have been explained before but and I read a few posts but was confused with so may references etc.

If someone is on SWV (since 2021 - renewed in 2023 - 5 Years in 2026) and was shortage occupation SOC 2137 in 2023 is being paid a salary based on old rate for SOC 2137 was £26,800 / 37.5 hours a week.

1) Can he continue on the same salary till he reaches the end of the leave.

2) for ILR will the old salary suffice or will he need an increment and if so how early before the ILR application.
which of the below will be required
a) new standard going rate £41,300 (£21.18 per hour)
b) or lower going rate £29,000 (£14.87 per hour)

Employer has been reluctant and delaying.

For settlement in 2026, In the same confusion soc 2135 which is now 2133, current salary since 2022 is 38,000, new going lower rate is 39,300. Confused if 29,000 threshold will be okay, or the current salary satisfies or do I need an increment to 39,300, if yes when does the increment need to be effective from?

Shortage occupation list does not exist. You now need to be paid the lower going rate based on your NEW equivalent SOC
