Sponor Letter For ILR

Post by UpcomingILR » Mon May 26, 2025 11:51 pm

Hi,

I'd like to make a query please about a sponsor letter.

I have been on a skilled worker visa (as a doctor in the NHS) since 2020 and my current timeline is as follows:

Date of completion of current contract - 07th August 2025
Date of expiry of current visa - 20th August 2025
Date of eligibility for ILR - 25th August 2025

It is quite unfortunate that I have such a small window of time (between 20th to 25th August) that I need to cover with a CoS and visa.

My current contract is unlikely to be renewed.
I have not yet secured another contract with a different employer but am in the process of applying.
I am trying to negotiate a 1-2 month extension with my current employer so that they can issue me a sponsor letter.

My query is, if I do manage to secure the 1-2 month extension and the trust issues a letter stating I am employed with them currently and am required for the foreseeable future, will it be a problem in my ILR application, given that the remaining duration of my contract will only be 1-2 months?

*If I do manage to secure an ILR, subsequent work opportunities should not be an issue as there are locum agencies that are keen to provide contracts but only to individuals who are already in the country as either residents, or on spouse visas or with ILR. These agencies do not provide CoS and subsequent visas thus it not an option I can opt for, prior to receiving ILR.

If you get such a letter, I do not see an issue.

Read: All you need to know about the sponsor letter for Skilled Worker route

Also, when did you apply for the skilled worker visa in 2020 ?
Are you aware of the COVID concession for people who applied in 2020-21 ?
Do you know that the end date on your COS has nothing to do with ILR application ?
Do you know you can accumulate lawful residence after you apply for your ILR under section 3C ?

Thanks for the speedy and detailed response.

I applied for the skilled worker visa on 21st September 2020. I have added 5 yrs and subtracted 28 days to arrive at the earliest date of 25th August.

I believe the above takes into account the Covid concession you have mentioned?

I wasn't aware that the end date of my COS has nothing to do with the ILR application, prior to your response.

Yes, I believe it translates to the fact that I am able to lawfully reside in the country while awaiting a decision on the ILR?

I guess it all comes down to either securing an extension on my current contract or securing a different contract in what little time that is left.

Yes, that is in line with the COVID concession calculations. COS end date indeed has nothing to do with it, however you need to be employed and wanted for the foreseeable future.
