I have a few questions regarding the EUSS (FM): Apply to the EU Settlement Scheme as a non-EEA family member or joining family member of an EEA or Swiss citizen application (Lounes route). There are some questions that I found a bit confusing and was hoping someone can clarify for me.
I have pre-settled status and I am applying as the spouse of an EEA & UK citizen. I came to the UK via EEA family permit application in 2020 and since last year my husband has become a UK citizen, hence when I applied for settled status online we were told to fill out the paper form as per the 'Lounes' route.
The questions are as follows.
- In 4.14 it gives me two options for what type of family member I am joining and I don't understand the difference? Below are my options
before 31 December 2020 - continue to section 4.15
I am applying as a joining family member of an EEA or Swiss citizen in another capacity -
continue to section 4.15
Since I joined my husband in 2020 would it be the second option? Bear in mind my husband has been living and working in the UK since 2004.
- In part 4.15 it asks about dates of residence in UK, well I have been here since January 2020 so it's simply Jan 2020- June 2025?
5.4 For what period are you relying on this family member’s residence?
For example, 05 2010 – 02 2015
Would the period be from the date I arrived to the UK until now?
Lastly with regards to evidence of my residence in UK. The earliest dated document apart from my entry visa is my bank statements from July 2020. Now due to COVID and me being a housewife I didn't register early for many things, indeed this was in some cases not even possible and I also had my biometrics done in February and it took a few weeks before everything was registered for me. If I provide a copy of my entry visa as part of my EEA family permit would that help? I am looking to send of my application soon so if they are strict and follow documented residence then I would roughly be a 'month early' for the 5 years residency period, would this be an issue?
