Zimbabwean in prison, Given deportation letter

Post by wamambo » Sat Sep 06, 2025 5:34 pm

Hey guys

Just looking for any advice. My brother was given a 13 year sentence 3 years ago for sexual assult. A few days ago he received a letter talking about possible deportation in the next few months. He has no wife or kids only siblings and parents in the uk.

Does anyone have any experience with this? Or know how things work or next steps. I am looking for a lawyer for him. Is this even worth it? Looking for any advice or help on the matter.

Many thanks in advance

What was his last visa before his sentence?
When the offence occured?
What is his country of nationality?
Was he given time to appeal the decision?

You can upload the letter wording redacting any personal data.

Be aware that as soon as your is classed as FNO the home office can deport him as soon as it becomes possible.
As he received custodial sentence of over 12 month he becomes automatically candidate for deportation. In many cases the HO will try to execute the deportation order as soon as possible to free up places in prison.

Hey thanks for coming back to me.

1 He is from Zimbabwe
2 He was actually processing to get his Indefinite leave.
3 They said no appeal but given 25 days to appeal under human rights etc.

I am waiting for a scanned copy of the letter.

So can he be deported any time now. He will locked up for 4 years by next year April.

Does he need to have served a minimum term before deportation or can be sent back ASAP, especially after getting that letter with intent to deport?

Once again many thanks for any response

So basically he did not have indefinite leave at the time of offense.
So the facts are he's single with no children. Parents and siblings are in the UK.
He received 13 years custodial sentence so the nature of the offence is severe and as you said it is a sexual offense.
What was his age at the time of the offense taking place?

I'll tell you my personal opinion. If you appeal the HO will claim that it is conductive to the public to deport him (e.g. in the public interest). My only guess is that they will remove him as soon as possible after the given 25 days.

If he had British children or long term spouse it may have been easier. What age did he arrive in the UK? What was his age when he committed the crime?
Are you all settled (e.g. parents, siblings)?
As it looks to me, I don't see a legal facility that can stop this deportation order. You can try citizens advice, but if you really want to give it a chance try to secure a consultation with a top tier reliable solicitor. It is for sure not a simple case.
The only good thing for him about the deportation is that if there is no prisoners transfer agreement with Zimbabwe he may become a free person there, if there is an agreement he may be transferred to continue his time in a prison in Zimbabowe.
