Skilled worker extension salary (not) too low?

Hello,

I am a visa sponsor.

Short explanation: My skilled worker is extending visa based on the previous salary when he arrived to the UK in 2022 of 28k per year for 40 hours of work per week. Home office just sent an email saying that salary is too low.

I have so far had multiple successful extension applications (latest one being 2 months ago) where I used the same salary details for skilled worker as in their original application. In most of the cases (including the latest one), salary was 28,000gbp annually for 40 hours of work per week.

However, today I received an email for the latest applicant, saying that this does not meet the criteria.

Can you please let me know why did this happen and what should I do?

My assumptions are:

1. If he already had visa before and is extending now, then the same salary is ok for as long as (point 2)
2. Salary meets the minimum pay per hour currently applicable in the UK (28,000k for 40 hours per week, for 52 weeks (holiday included) means that pay is 13.46gbp per hour).

Here is the email (first paragraph out to remove private details). What should I respond?
We have received an application from the above person to work for your company as a Chef.

We have started consideration of this application, however before we can proceed any further, we require further information.

Can you please confirm the salary of the role which is being offered to the above named applicant as the salary stated in the Certificate of Sponsorship does not meet the minimum eligibility requirement.

Please add a note to the certificate of sponsorship to confirm your request so we can process the application accordingly.

You can add a note to the Certificate of Sponsorship (CoS) using the following steps:

1.       Go to Workers
2.       Sponsorship Duties
3.       Managing live certificates
4.       Search by using the certificate number or name
5.       Sponsor notes
6.       Add in free text comments

In addition, you can get screenshots on how to add comments by going to the top right hand corner and choosing a tier.

Alternatively, please send this information to worksponsoreddocumentrequests@homeoffice.gov.uk quoting the application reference.

Please provide this information within 10 working days from the date of this email. If we do not receive anything within 10 days, we will make a decision on the information we already have.

I can see that it looks like the treshold was recently increased to minimum salary of 31,300.

If he was in the UK from 2022 on salary of 28k, does it mean that new minimum salary for his visa renewal is now 31,300?

You can check here but if he had his visa from 2022 continusely then the salary you wrote before should be correct as he should be eligible for the lower going rate.

He's subject to the global minimum as it is higher then the lower going rate for this occupation.

Can anyone help please because my response deadline is in 2 days?

I am really not sure what am I supposed to do regarding his salary.

What is the minimum salary he can have as a chef now, since it is visa extension based on the visa from 2022 when he had salary of 28,000gbp for 40 hour work week?
