Conviction sponsor for spouse visa

Conviction sponsor for spouse visa

Hi one of my friends has a conviction and is applying for fiancé visa then spouse, he was previously married and sadly has a domestic abuse conviction- does this prevent him getting spouse visa for his new wife

The crucial questions are
(a) Is he legally divorced from the previous spouse?
(b) Is the date for the marriage to the new spouse on or after the date of the decree absolute of the divorce of the first spouse?

If the answer to either of them is No, he can't spouse the new spouse.

Many thanks for the reply, they were divorced 2 years ago he has the decree absolute

I do not think that there would be an issues with a spouse visa application.

BUT given that the conviction is for domestic violence, you may want to (a) wait for others to advise and (b) consult an immigration lawyer who is also well versed in domestic violence cases.
