working while awaiting the appeal decision

Post by megastar » Wed Jan 14, 2009 7:00 pm

Hi all,

i got refused for PSW extension because of online bank account. this is clearly a descrimination. following is an excerpt from UKCISA email.

It is clear that the UK Border Agency’s policy intention is to accept statements that are signed and stamped without the need for an additional letter. If your students are able to obtain a letter, which is still required according to the policy guidance, it is advisable for them to include it with their application. If this proves impossible, they should be able to rely on the information contained in this email. If a student is refused solely on the grounds that they failed to provide a letter from their bank but they did provide signed and stamped online statements, please let us know so that we can raise it with the UK Border Agency to ensure that caseworkers are dealing with applications in line with policy advice. A student in such a position should also be encouraged to appeal against the refusal.

i attended the tribunal hearing for which HO representative failed to attend. i am awaiting the decision.

as you know that passport will be with me until the decision comes, my employer don't know about all this refusal, appeal etc etc...

now my employer is asking for some kind of proof from HO people confirming that i am legally eligible to work until the decision is made. please do advise how and where to get this confirmation from?

thanks in advance for all the information.

nope.. but in the mean time i got refusal from the tribunal. the judge was a dickhead. he never even considered the additional grounds. dearly beloved.
in the letter he was saying the bank statement is fine but it has got no name. how someone can write/print their name on a online printout :?: which even the bank cant do.(if they can, i would have never got this problem... right)
i am least bothered. i had enough tension.
i will inform my company(i am working as a product development engineer since oct'08 with £25K) and leave to my home country.
:)

Bye everybody
