Good Evening everyone,

I have been following this thread for a while now, and I truly appreciate all the free advice and support provided here to help people with immigration matters.

I am making this post to seek guidance and avoid any costly mistakes, as I am planning to submit my ILR application soon.

Background:

I entered the UK on 30 June 2021 to join my parents under the family route as a child dependent when I was 15 years old. One of my parents is a British citizen, while the other was on limited leave to remain at the time, with 14 months remaining before it expired.

My visa was granted for the same 14-month period, expiring at the same time as my parent’s leave and I have been renewing as at when due. The initial approval was under the standard 5-year route to settlement.

I would appreciate clarification on the following two points:

1. ----- The correct Link/form to use for my ILR application, as I am now 20 years old still living with my parent.

2. …… The correct date to apply, taking into account the 28-day rule before completing the 5-year qualifying period.

I have the following dates on my approval documents:

Approval letter dated: 4 June 2021
Biometric card issue date: 6 June 2021
Date of entry to the UK: 30 June 2021
The letter also states: “Your application for a UK visa has been successful. This means that when you arrive in the UK, you will have permission to be in the UK (known as Leave to Enter) as CHILD APP FM (STANDARD) from 10 June 2021 to 13 August 2022.”

What is the UK immigration status of the other parent now?

You did not have a min residence requirement for ILR and so you should have applied for ILR in the same application as your parent via form SET(M). I am not sure why you did not do this.

I believe the child settlement from should be used now: https://visas-immigration.service.gov.u ... ment-child

Zimba please what do you mean by "min residence requirement for ILR"
turned 20 years old when my other parent qualified/applied for ILR.

can I apply immediately now since my parent got his ILR or what dates am I qualified to apply based on the dates stated on my post above

Children do NOT have an ILR residence requirement. There is no 5-years or whatever. The fact that you became an adult makes no difference whatsoever. Children can settle with their parents. You qualified the moment your non-British parent got ILR and as I said, you could have been part of the same application.
