ILR 10 Years Route - Request for Clarification

Hi,

I came to UK on 11th April 2017 on ICT Short term visa and would become eligible of ILR 28 days earlier in Apr 2027. I went to India by end of Mar 2018 and returned to UK with family on 16th Jun 2018. Here are my detail.

Since my family came after a year, they would only be eligible by Jun 2028. In this case i am considering the following options,

Option1: Apply for ILR for me (hoping there are no changes) in Apr 2027 and apply for a minimum of 3 years Skilled visa dependent visa for my family as i cannot apply for a year (based on my reasearch). Once they are eligible in 2028 i can apply for ILR but would not get any refund of IHS charges. This option will lead to me spending around 15k for visas and some more for a solicitor.

Option2: Considering the option that i can go for 2 more years of Skilled visa extension and then apply ILR together avoiding spending the 15k(with assumption that the visa extension and ILR charges are paid by my employer).

My gut says to go for Option 2 so that all can apply at the same time (assuming there are no issues with the ILR rules).

Please advice.

You can do both, depending on your priorities. Note that the ILR rule changes in the future are not predictable, so not securing ILR at the earliest and as the rules stand means unpredictability in the future.

If i apply for ILR next year, can i apply ILR for my child as well(who came in Jun 2018).

Assuming child is born abroad, they will be eligible for ILR with the second/less-privileged parent.

Children only qualify for ILR when both parents do. They cannot settle when one parent only settles, regardless of where they were born.
