I want to import my wife from Pakistan

Post by K-OSS » Tue Jan 20, 2009 6:00 pm

Hi there guys, I have a few questions... I've been working part time for almost two years. I Recently (last year December) opened my own company up manufacturing and retail (also importing and exporting). I make on average about 1,500 pounds a week in profits. I can prove this via bank-statements, and evidence of sales. Now, where I work part time its just for fun, it is not for the money, I make like 100 pounds every two weeks form that part time job, I do about 8 hours a week.

Now I spoke to a lawyer and she said, transfer the company to someone else's name, otherwise it will become too complicated to be applying via being self employed as the company has only started recently, it would not have been a problem if it was established for like 2 years, since its not been a year, you can't prove it would be sustainable.

I don't get it, what is the problem if I can prove I make 1,500 pounds a week. I have saving of like 30,000, and also own my own home 4 bedroom (cashed) I also own some lands and buildings in Pakistan. I can prove all of this, and have not claimed dole money.

Is my solicitor right or is she just trying to get me to give her more money?

By the way my sister is a chartered accountant, and she says I could be in a real mess, like in the sense of taxes, she says my accounts are in a mess, and I might not have been filling out my taxes correctly.

Its just starting to sound too complicated.

I thought it would be simple, if I can export vans to Australia I thought this would be a walk in the park.

I thought that goods get exported, not people! Is your mind still on work?

I would listen to your sister, what good is getting the company in someone else's name going to do. At least she will help you with your accounts.

You also have good savings, unless this is the turnover of your business & needs to be paid out in tax!

Yeah my bad, am obsessed with work... I even dream about work.

I have savings personal savings 30,000 pounds, the turnover of the company is much higher (the projected turnover of this year should be 500K) projected profit is 80 - 90 K.

Sister then!

See what other people say about the evidence you need if you are self employed/run a business.

Do you have evidence of where the £30k funds came from, old pay slips for example or accounts from another business.

Yes, I also own a web-development company in the US, but it is not specifically in my name. My brother manges it, (his American) and works for the US Air force his an air force aircraft designer. He has employees, and I make 30K profit from the business every year.

The problem with my sister is she is too pedantic, she said "I am horrified, by the state of your accounts, you need to organize" lol I would have to pay her though for her to sort my accounts out, we are all pretty competitive.

I would blame you sister for not managing your heavy accounts. You may need to contact accountant who does corporate accounts???

I can refer some to you if you wish.

If you are running a company, ie if you are director or shareholder of a company then you are not self employed. You are actually a employee of that company. You can imagine a company like a person in itself. I wont want to start discussing the whole accounting thing here, but basically your lawayer doenst know a thing about tax and accounting matters. if your company has made profits and you can show the documents to prove that you are the shareholder of the company, then immigration would have no problems with you. PS You will be called self employed if you start working for yourselves and then you have to register with HMRC as Self Employed. Dont confuse SElf Employed with running a Limited company, as i think you are doing now.

You perhaps need to get another lawyer as it seems this one you got doesn't know much at all!!!

I have my own limited company and I submitted my self bill invoices instead of pay slips with our application. I also submitted my company accounts complete with company bank statements that my accountant drew up.

Get an accountant to have a look at your accounts. Make sure they are all up to scratch and as long as you provide all your bank statements and anything else to show where your money is coming from and going to there should be no problem.
