Can a new visa be obtained after overstay in Belgium?

Post by vandarlust » Tue Jan 27, 2009 10:11 pm

Hi all,

One friend of mine from India stayed for 90 days in Belgium not knowing that her visa was valid for just 30 days. She has gone back to her country 1.5 months back in December 2008. When she left Belgium her passport and visa details were noted in computer system by the immigration officer in the airport though she was neither asked to give any fine nor was she detained. She has got a job in Belgium now. Her company has applied and received a work permit for her.

Can she get a new visa with her work permit in hand from the Belgian consulate in her country now?

When was the visa valid from and to? Does it say "maximum duration of stay = 30 days"?
When she left Belgium her passport and visa details were noted in computer system by the immigration officer in the airport though she was neither asked to give any fine nor was she detained.
Don't think detention is required in this case. An alert/warning against her file would be entered into the central SIS which is accessible by all schengen member states when she makes future applications.
She has got a job in Belgium now. Her company has applied and received a work permit for her.
Can she get a new visa with her work permit in hand from the Belgian consulate in her country now?
Why would she need a new visa from the Belgians if she's already been granted a Belgian work permit? Are there travel restrictions on it?

Question: When was the visa valid from and to? Does it say "maximum duration of stay = 30 days"?
Answer. The visa was valid for 30 days , from 15th Aug 2008 to 14 Sept 2008. Yes it said Maximum duration of stay 30 days.
Question Why would she need a new visa from the Belgians if she's already been granted a Belgian work permit? Are there travel restrictions on it?
Answer: Once she went back to India she applied for a job in Belgium and she got the job. Her employer has got the Work Permit which is a card required to presented along with her passport, Medical Certificate and police clearance certificate in the Belgian Embassy in India to acquire a work visa.

If the Belgian system works like Germany's - which it might, maybe a EU system, is that u get the WP granted, then u enter on a single entry short term Schengen visa granted at the local consulate, enter the country, visit the Labour Office to get the WP
