Conflicting answers

Post by Chris » Tue Jun 14, 2005 12:07 pm

There is a conflict here in the 2 answers.
Basically if a passport expires after 2 years and Work Permit (not HSMP) applied for is 4 years then

1)Will the Work Permit granted by WP UK will be for 4 yrs or only 2 yrs(because the passport expires after 2 years).
2)If the WP is granted for 4 yrs then will the FLR visa stamp have 2 years validity or still 4 years.

Having gone through these 2 post there is conflicting answers. Whats the fact for Work Permit holders?

A while ago I have been told by a consular officer that no visa can exceed validity of the "carrier" document, that is the passport, because a visa is worthless without a passport. I realise that is a problem (my wife has the same issue and will have to return to our home country, get a new passport and apply for EC at the embassy to return) but that's how the rules are. You may want to call the Home Office to double-check though.

Hi Chris

Your visa date is not dependent on the expiry of the passport. For both my work permit visas the expiry of the visa exceeds my passport expiry. You need to carry your expired passport with a valid visa along with a new passport to gain entry. I have travelled using my expired passport with a valid visa along with a new passport with out any hasstle.

Hope it helps
take care

Yep I too agree; my WP also exceeds my passport validity date. I am planning to extend my passport with my valid visa.

I work for Immigration Department (Solicitors).

Indeed, your visa is not tied with the expiry of your passport.

Make sure you have your old passport on hand when you apply to IND for a visa transfer to your new passport.

Yours,

Anton
