Post by vipul1981 » Mon Feb 02, 2009 11:47 am

can somebody help me,

Can u pls explain what is the definition of criminal offence,

My friend wants to apply for tier 1 in next few months from UK. He had a fight couple of days ago with a guy at one of the house parties. they exchanged swear words and few punches. and the other guy had swollen face and reported it to police. where does he stand now? and what can happen. they both were drunk and both were fighting.

anyone?

What action have the police taken so far? My understanding is that he needs to have been charged with an offence first and then convicted for that offence. If nothing has been done so far, then he does not (yet) have a criminal offence....or that's my understanding anyway!

Hi,

If the police has taken his details and he has been charged for this offence, then he as to declare it on the form. But if not, he can describe the scenario and explain that he has not been charged yet. That makes him free from any future problems with the HO in this connection. It better to declare than not.

I wish him well.
