Hi Folks,

I wish to clarify couple of queries with regard to my wife’s Tier 1 (General) application. She is currently in the UK on a work permit and wishes to switch to Tier 1 (General) Highly Skilled Worker visa.


1. Kindly clarify the question D5 in the application. We are not sure about the option to tick. She arrived in the UK on a 5 year work permit valid till 2012 but she had a change of employment last year and subsequently obtained a leave to remain that is valid till Oct 2009. In this regard her current leave to remain is still available; hence should we tick the option ‘Yes’ in the application? Please clarify.

D5. Are either the applicant’s current and/or any one of his/her previous passport(s) or travel document(s) that he/she has used to travel to, and remain in, the United Kingdom which shows his/her current leave unavailable?

Yes
- go to question D6
No
- go to question D11

Please note for the application to be valid and complete the applicant’s current passport or travel document must be provided unless it is not available for one of the reasons specified on the application form.

2. As I mentioned earlier my wife had a change of employment last year and started her new employment on 16-06-2008. Due to administrative reasons her employer pays her salary with a one month delay, which means she received no salary by end of June but received her June salary by July end, July salary by Aug end, etc….However after receiving a pay by end of Jan 2009 she meets her points criteria for Tier 1.

In such a scenario should her period of earnings be 16-6-2008 to 31-01-2009 or 01-07-2008 to 31-01-2009. Please clarify.

With regards to your first question, it is asking if she has the passport with which she entered the United Kingdom (i.e. the same passport that she gave to immigration control when she entered the country).

Thanks drjabberwocky23. Yes, she still holds the same passport with which she entered UK. So I believe she needs to tick 'NO' for D5.

That's right. I'm assuming that the passport she used to travel to the United Kingdom is the same passport she has used throughout her stay here (no passport renewals, etc.)?
