Will Spouse Absence from UK affect ILR?

Post by hsmp_seeker » Fri Feb 13, 2009 3:56 pm

Hi,
I am currently in Tier-1 General with my dependent wife. I am planning to apply for ILR in Jan'2011. If my wife takes a holiday and lives out of UK for the next 4 months continously, will she be rejected during ILR?

Thanks in advance.

Most likely yes.

4 months is a bit of a long time to be absent. She can go, but there is a chance that she will have to apply for further leave to remain before she gets ILR. She has to make the 4 months up before she will get ILR.

Although there is no time limit on this issue, but if a person has to go abroad for a short period,of say 2-4 weeks within the first 2 yrs, it would not count against a person. However 4 months is a bit to long and will need FLR first
