French 10 years resident permit CART DE RESIDENT in Holland

Post by Chodron » Tue Feb 17, 2009 1:44 am

Hello:

I would like to ask about the possibilities of staying (live and work) in the Netherlands with a 10 years French resident permit.

This is my situation: I am Non-Eu who got married with my husband (French citizen) in 2003. After 2 years, I got a 10 years resident permit (2005 - 2015). In 2005 I relocated to Holland because I got accepted in a school of my dream which I can't find in France. Last year (2008) I finished my school, and want to stay in the Netherlands, because the environment here is much better for my career (the network from staying here for 3 years plus its uniqueness for this sector in Holland that I can't find in France). My husband still lives and works in France and didn't (also will not) move to Holland to live with me.

For now I am holding an extension visa from the student visa called Zoekjaar (search year) which only lasts till June this year. It's about time to solve the permit problem.

My question is that are there any any possibilities to get a Dutch resident permit with this 10 years French resident permit or it's totally useless? My dilemma is that even I can start the procedure of applying for French nationality, but during the last 3 years studying in Holland, I basically live separately with my husband. In this case, I think it could cause problem to apply for French nationality. Because I don't have the physical records (mobile phone bill, bank account, an income ...etc.) of living in France. Otherwise it could be the best solution. But I need to start all over again to get a permit in Holland (which is not easy at all because of the severe Dutch immigration law. I would need to spend lots of money to consult a immigration lawyer. Getting the working permit through employment is tough (it has to meet a certain amount of salary plus lots of papers for your boss! Most of the employers will avoid all those troubles. I would prefer to work as a freelancer. The easiest would be through the partnership, but I am not allowed to apply for this because I'm married) What could I do to stay in Holland?

Thanks in advance!
