Questions about transferring from WP to Tier 1

Hi all,

I am in a circumstance which I am a little confused about.

My company (refers as CompanyA) is recently take over by a big company (CompanyB). The "Change of Technical Employment" application which transfers all the work permits from the old company to the new company has been submitted by the new company and currently being processing.

However, the new company (CompanyB) is about to sell our department to a third company (CompanyC) probably in a month time.

To avoid further WP transfers and possible troubles, I decide to submit my Tier 1 application.

My questions are:

1. Is it OK to submit a Tier 1 application while a work permit transfer application is being processed.

2. My current work permit allows me to work in CompanyA. The application currently being processed entitles me to work in CompanyB. If my department is sold before the Tier 1 decision is made, am I eligible to work in the third company (CompanyC)?

Sorry, it is a little complicated. Hope someone with the similar experience can help me.

Wont make a difference. Please refer to Tier 1 guidance documents for more details.

On the application form in question D26, do I need to declare that I am currently having an application waiting for decision?

I think it would be better if you do.. Just mention the same in your cover letter too.. with proper justification(Others please correct if i am wrong).

I am sure you are eligible to apply for Tier 1 even if you have change of employer application for Tier 2.. as long as you have Valid UK WP you should be fine..

I would be honest and declare these issuses on cover letter.

Question D26 says:

D26. Does the applicant currently have any other applications with us on which he/she is awaiting a decision?

Because the work permit transfer is not the application I submitted, it is the company that submitted it. My understanding is that it is not the application I have. Then I do not need to declare it. Is my understanding correct?

If I want to declare in question D26, I need to provide the payment reference number of the WP transfer application. I have no way to obtain the number from our HR department. Is it still OK to declare it without providing the reference number?
