Old Workpermit to Tier 2

Post by cuddles1902 » Tue Mar 03, 2009 10:55 pm

I have a 5 year workpermit valid until 2011. Now that Tier2 has been introduced, I have a couple of queries:

When I near my 5yr duration, what do I apply for?
I mean, I apply for fresh Tier2? or an extension of workpermit in Tier2?

I am not clear with how the UK Border Agency has described this on their website. So any assistance is appreciated.

With Labour changing rules every now and then, Is it possible to move onto Tier2 right now, knowing that I still have 2 yrs on older permit?

Thanks to all.

If you have spent 5 year in the UK as a work permit holder, you could apply for ILR if you are eligible. No need to go for Tier 2 unless you change employer or role.

Agreed, but isnt there a requirement in ILR whereby I can only apply via Tier 1 or Tier 2? making it mandatory to apply from WP --> Tier1/Tier2 --> ILR ?

Thanks for your response.

No, your current WP is equavalent to the Tier2 until it expires and if ILR time (5yrs) stays same you can apply for ILR but unfortunately if it is increased than u need to extend ur WP to Tier2.. but at this stage u r ok to appply for ILR once u complete 5yrs...
