Apply for Tier1 within 28 days after WP expires

Apply for Tier1 within 28 days after WP expires

Hello Chaps,

My application for Tier1 is still awaiting further consideration even after nine weeks. I'm thinking the worst scenario: can I re-apply for it if I get rejected within 28 days after my current WP expires? Your response will be highly appreciated.

You need to confirm.. BUT "I THINK" that the 28days after the WP or visa expiry is just a grace period to clear and move out of the country and i think the applicaiton sent after the date of expiry of your visa will not be considered or valid

just wait for some more members to re-confirm or elobarate on this

tvn_ramesh, Thanks very much for your prompt reply. I got impression that one can look for new jobs or file another application for Tier2 (WP) within the grace period. But not sure whether it's also eligible for Tier1 applicants.

Dont get discouraged...

i dont know ur exact date of expiry of ur visa...

But WP or Tier2 process is very long/complicated but if you can find a job, complete the process of Sponserlicense of ur new employer and Issue of Certificate of sponsership for you for the new job and if you can apply for Tier2 even just 1day before your expiry date than you are safe,,, but there all lots of IFs and BUTs here..

as mentioned above just wait for seniors to reply abt 28days period to apply== i am not sure abt it sorry

Rules are very clear for Work permit/tier 2 holders. If you want to apply for an WP extension under Tier 2 with same employer, you have transitional arrangements.which exempts existing wp holders from new rules.

If you want to join the new employer, new rules apply. If you leave existing employer,28 days rule kicks in. within the period either find new employer who is ready for tier 2. or leave the country.

you should file for WP extension with your employer if you still have the job.If tier 1 gets rejected , you are still covered. File for WP extension 2 weeks before your visa expiry. If you need more suggestions, explain your situation in bit more detail.
