Please help

Post by sonia14 » Fri Jul 08, 2005 10:06 am

My cousin came to England age 14, 1967 from Jamaica.

He is a divorcee from a 17 year marriage and has six children (eldest being 25). I would like to travel with him for a family reunion to Jamaica.

The problem is I have suddenly found out that he does not have a Jamiacan nor British passport. I have made all the travel arrangements to travel to Jamaica on the 26th July. Would he be able to apply for a Jamaican or British passport and if so, would he be able to return back into England if he used a Jamaican passport? What status does he have? He has worked during all his adult life in England, he has an NI number, mortgage, own car, children are British etc

Please can you advise me.

Yours Sincerely

Sonia

1. On what travel document did he enter the UK?

2. I appreciate its a long shot but on the assumption that he entered on a parent's travel document does he have access to such and what do any immigration endorsments on this document state?

3. Doe he have any correspondence from the Home Office?

Needless to say this is not going to be resolved prior to your departure date so cancel or postpone.

Hello Kayalami.

1. My cousin came to England on his own Jamiacan passport.

2. Documentation was already sort for him to enter England to be re-united with his mother. Mother passed away June 1997. He has lost his Jamaican passport June 2005, lost property no: 2328/05.

3. He has now correspondence with Home Office.

My cousin attended school from 10.03.69 after arriving from Jamaica and left Elliott Durham 17.10.70 (Attendance Certificate at hand).

He has a national insurance number, a mortgage and a full driving license. He is not illegal.

I have been informed that people can travel on "temporary travel documents". Therefore, I would like to know the procedure so my cousin can make an immediate application.

May I also stress that his flight has been purchased by our family overseas and is non-refundable.

Please advise.

Sonia.

Sonia you write :-
Documentation was already sort for him to enter England to be re-united with his mother.
What was the nature of that documentation?
He is not illegal.
You might well be right but your justification for making that statement?
I have been informed that people can travel on "temporary travel documents".
That might be so but that in itself does not guarantee him re-entry into the UK. He can get a new Jamaican passport?
his flight has been purchased by our family overseas and is non-refundable.
Even so, he should not leave the UK unless he knows for certain that he can get back in. Assuming of course he does want to get back in.

Dear Moderator.

My cousin has no documentation what so ever inrelation to his arrival to England. His mother died 9 years ago.

I made a mistake in answering one of your questions ref: correspondence with Home Office. My cousin has never and has no correspondence with HO.

There is no evidence of my cousins existence in England. he has his school attendance certificate and the previouis documents I mentioned to you as above i.e. no British or Jamaican passport (or Immigration documents).

Please may I make you aware that my cousin came when I was 2 years old. The documents you are asking for I do not know what they are.

Does he have any legal status in England?

Where does he go from here?

One way of proceeding would be for him to apply for ILR, on the basis of at least 10 or 14 years residence in the UK. That would at least give him a basis for staying in the UK legally. Then later he would be able to apply for Naturalisation as British.

But also, has he tried to get a new Jamaican passport? After all he would need a passport into which any visa would need to be entered.

There might possibly be other ways of proceeding, but the above is certainly possible.
