PSW - applying from India - Success rate?? Your opinions plz

PSW - applying from India - Success rate?? Your opinions plz

Dear all,

My PSW application refused on 13 Mar '09 and the reason was the letter from college didnt indicate the date of award of Degree Certificate. (FYI - My letter clearly said that I passed MSc with distinction, period of study, name of the award, awarding body, but no Degree certificate award date. Interestingly, some friends who applied with the same letter format got their PSW by early March. They applied by Jan 10th and me by Jan 24th. I dont understand the way HO assessing the PSW applications).

Rather than appealing, I plan to go India due to some family emergencies by mid May. Bcoz if I go for an appeal now, I think the entire process wont be finished before the end of May (6-9 weeks??). That's worrying me. Also, not sure about the appeal winning chances as my solicitor didnt say much positive because of the letter from the college missed the date of award of degree.

Any way, I would like to know the success rate of applying PSW from India. Some of my friends are saying its very hard to get it from India and a large number of applications are being rejected now a days. Any inputs? If any, what are the points we need to care most while making the application??

First, dont panic.

You can do an outside country appeal as well. Your solicitor is scaring you. If possible, ask for another letter from your Uni and apply in person before your are going to india, however Its better to seek advise from another solicitor who deals with immigration specially in student cases!!

But my visa has been expired on Jan 31, '09. I think the only option i have is to either appeal or re-apply from home country.

Any idea, how long could the appealing process takes if I apply by early next week?

The appeal process will take anything from 6 to 9 weeks. You do have to very patient during appeal process. I would advise you to appeal rather than lose your status in the UK go back and then apply again with the new visa fees, Which could again take sometime. Keep a cool head and evaluate all your options i.e. pro and cons before you make any decision. In appeal you have nothing to lose! BUT the final decision is ofcourse yours

Would like to know, if I appeal, can I withdraw the application any time during the appeal process? (applying for appeal/hearing/visa stamping)

I asked this because, in case if I need to go back to my country while the process is being going.

Any help would be really appreciated.

You have a good chance of winning the appeal. Yes it is true that they are getting harder and harder on UK immigration and UK Economy is in deep recession and they want British jobs for British people, In indian do you think they would give you PSW easily? (i dont think so), The red tape is even redder there!

I would say fight for your right while you are in the UK as you have nothing to lose and once rejected in the future whenever you make a UK immigation application you will always have to specify that you have been rejected once! but looking at your case you have a good chance of winning. BUT the final decision is yours.
