Home office lost our file - waiting for last 6 months

Hello seniors,

Complain department let us know that Home office - case worker has lost our Hard file with 2passport + marriage certificate + bank statement + University papers & everything…..
They forwarded this matter on special department who are working on missing files & try to find out internally. Still if they can’t find it then by next week they will issue letter for claim so we can claim for our loss.

They said you have to reapply for your visa but before we have to make everything again like have to apply for passport & everything again ----- and I m sure that new passport will be our duplicate passport because they lost our original passport in that I have Singapore & Malaysia’s valid visa for holiday which I got it in 2007 for couple of years & it was valid till 2009.i don’t have any Xerox copy for these visa’s.

We are so sad; my husband is qualified scientist as we had paid £12,000 fees to Bradford University. & he is without job for last six month due to our passports delay & now they are saying that they lost our file.

Can any senior advice me what are our rights apart form claim as we don’t want claim but we want our original passport is there any either way they can grants us any ID certificate or something which we can use for travel & job purpose meanwhile they can search our file I sure it must be somewhere internally they will find it in due course. We really don’t understand what we will do as it is was so hassle for last six month & still another problem has created what is our fault and why we will suffer for there carelessness. Please advice what are best options in our case? Do we need to go Immigration solicitor?

1) Hi, sorry to hear this. I can advice you on passport lost thing. I have been in similar situation before. You will have to submit photocopies of old passport / uk visa and new passport application form / driving liscence / birth certificate of that country / proof that you are national of that country (India/Pak etc). You will have to submit this in the Indian/PAK embassy in uk whichever applies to you. Also you will have to attach all the copies of your uk visas and communication from Home Office (letters). Get a copy of the letter from complains department in post attach that as well. Submit all this in your nationality(india /pak whtever applies to you) embassy in UK. That embassy will give you a date to come back and check with them. This embassy will get clearance for new passport from the city where your passport was previous issued. Once they get that normally it takes (2-4 weeks if you submit everything mentioned above). Your new passport will be issued.

2) In meantime keep chasing UKBA if the decision was made for you case and get a letter from them regarding it. It will be on their system. If the decision was made and positive then tell them to send that letter and fill up NTL TOC form only if PSW visa was granted and stamped byt ukba. Also approach a solicitor. There are lot of case that happen like this and claiming wont get you what you expecting. But you need to keep on fighting and pushing UKBA now. Write a letter to local MP may be he can help and push this in matter.

3) singapore malaysia visas issued wont be valid now and they wont re issue it on new passport. you will have to apply again. I had the same problem. I had singapore visa. Because travel visa is issued to that specific passport number and whenn you get new passport with new number the embassy writes on 2nd last page under observation that old passport was lost and new one issued. that is just for their observation, it doesnt affect in any way. So dont worry about that.

As far as we know decision was not granted yet it was under consideration because they lost our file so how they will take any decisions until we can make new papers & what we can do in this new documentation procedure I mean if we would to travel or so how long we have to wait also no job for my husband. We already cancelled our ticket in Dec & lost £500 due to delay in our passport
What about our other country’s visa its all double work & hassle for us & it’s all mess now. We have to bear all this solicitor cost and everything.
And we don’t know what will be the result at the end of the days …..
