Naturlisation question for ILR holder

Naturlisation question for ILR holder

I was on asylum and got my ILR after ILR last year in Nov 2008 after 8 years.

My question is when would i be eligible for naturlisation?

Some ppl say i need to wait for another 5 years and some say i can apply in Nov 2009.

Which statement is true??
Arrived UK in Dec 2000, Received ILR Oct 2008, Citizenship Approved March 2016.

hamid84, this is actually quite a complicated matter. You need to appreciate that throughout the 5 year period, up to when you apply for your Naturalisation, you need to have been "legal". Clearly you have been "legal" since the ILR was issued ... but before that?

You need to explain a lot more. When you arrived in 2001, when did you apply for asylum? Immediately on arrival? If not, how much later? Also, when you applied for asylum, did you have a valid visa at that time of applying?

Hi John,

I arrived on 6 Dec 2000. Had valid visitor visa.. Applied asylum in person after 2 days of arrival.

Never stayed as illegal.. Yes deportation order was served in 2005 but after 5 days struggle we came out.

Granted asylum and ILR in November 2008.

Lots of family n Friends have applied for naturlisation after being granted asylum... How did they do it?

Hope i have answered all questions...

You'll have to live in the UK legally 5 years before you can apply for naturalisation. You can apply for it straight away as you've been here longer than that.

Sorry you were not on a visitor visa, then applied for asylum and then served with a deportation order. The deportation order indicates possibly having an illegal status. Why were you served a deportation order?

In Dec 2005, HO tried to remove us and we were then taken to detention centre where we spent 5 days but later came out.

Does that mean we were served with deportation order?

We all had valid Visitor VISA when arrived and then claimed asylum.

You said you were served a deportation order.
There is no visitor visa for 8 years.
You have to know the basis of the deportation order, now really?

As far as i can think of, we did not get any formal letter for deportation.

Immigration officers simply took us from home and told us we were going back to Home Country.

Does that help? :?

You were detained to be deported but you WEREN'T deported. correct?
Were you living legally before you got the ILR? may be on humanitarian protection ground or home office issued temporary visa every 6 months or so until they made a decisionon your asylum application.

Best to check your eligibility with your solicitor.

Put it this way, it wasn't a legal status but they weren't illegal.
IT was more like limbo. Based on the how it normally works, his stay doesn't qualify for citizenship 1 year after ILR.
You will have to wait for 5 years after ILR. And I agree with hmm
talk to your solicitor.

Before we asylum application was just pending as normal and we were legal in the sense that we were provided house by NASS, studied and bla bla bla.

Solicitor said we can apply after 1 year but i don't believe his words thats why confirming here.

Then what do you want from us
I dont think so and I told you why
If your solicitor says othewise, and youdont believe it, get another solicitor
