Hi can anyone advise

i am uk citizen by birth and my wife is african, almost a year ago she was given 2 year spouse visa with view to settlement, everything has been good and we are both working and making a success of it . now we want to bring her 8 year old son from africa to join us. He has not had a father since birth and he has been living with my wifes mother for the past year, because we didnt apply for him at the same time my wife applied does anyone foresee a problem with us getting him a settlement visa now, I have read all i can find and cant see much problem but i know some of you guys are far more knowledgeable than me on these things. any comments would be greatly appreciated

At the British High Commission in Africa, you will almost defo need to prove that the child's father is not in the picture (eg. death certificate, sworn affidavit from him, etc). Proof that she is the mother like his birth certificate naming her as the mother, or DNA test if necessary. Your finances should be good as well ofcourse! Best of Luck!

she is from Liberia , my wife was never married to the father of her son , will we still require proof that he has not been around, finances should be ok , i earn 38k per annum, she earns 12 k per annum with little outgoings , just worried bout the father situation , he left liberia before the son was born and my wife has no idea where in the world he is , so getting an affadavit is out of the question and because they werent married there was no court order over custody

Even though they were not married, is the father named on the child's birth certificate? If he is, I think the embassy will give you a hard time. If he's not, you might be able to get away with it. What about the father's relatives? Can they not help to trace him, or at least to let him give consent? Be prepared for a battle, but it's not impossible. Best of Luck!

I hope she declared him on her spouse application form or I can see there being a huge problem.

well when she registered the birth she didnt want to leave the fathers name blank so she put her cousins name as the father ( not same name as hers ) he still lives nearby, what would we need from him? .

yes we declared him ( her son ) on all of her visa applications

Well, there you go then! Let this man (cousin of hers) whose name appears on the child's birth certificate, sign an affidavit allowing the mother to take the child abroad.

Thanks for the help above, we have the affidavit sorted now.

i am now tryin to fill in the application form now and could use some advice,

i am filling in the form for my wifes 8 year old, when it asks for the sponsors name , do i put me (the uk citizen) or his mother, my wife ( who has a 2 year spouse visa for uk?

if i put my wife as sponsor then all the finance questions are aimed at her and she makes only a fraction of what i earn, will they base the decision only on what she earns?

can i put us both as sponsors?

You be the sponsor, as the child's step-father. My husband (EU national) was the sponsor for my child's when we were bringing him over. So it will be your finances they will take into account!

Any ideas what we will need for proof of sole responsability, he has been living with my wifes mother for 8 months while she has been in the uk, we have all the money transfer reciepts of the money we sent and a lot of phone calls on our house phone bill , but little else, there is no postal service in her country so no letters , no electricity so no emails. of course the high commision website is very vague about the proof thats required

Don't worry. The money transfer receipts, phone bills, and the affidavit should be okay. We didn't even have the money transfer receipts! The MAIN thing is the affidavit, that the 'father' has no objection to the child being taken abroad by the mother. You'll be alright. :)

am i supposed to put just immediate family such as father, mother , brothers and sisters

or do i have to list everyone AUNTS , UNCLES, COUSINS ETC

i have put his mum, dad and grandmother who he lives with at the moment, but i have not submitted the application yet

Mum, dad and gran he lives with is fine. Also, if he has any brothers and sisters. Otherwise that's it. To put aunties, uncles, cousin's, etc.. the list would be endless, wouldn't it? Especially for us Africans. Half the people in my country are related to me one way or the other, anyway! :) But it is important to put the granny, as she was the one taking care of him.

wanted to ask if maybe i have messed up our application

The application was put in on 5th march to british embassy sierra leone , my wife and her son have to go back to the embassy on april 14th for decision .

here is my worry

i have given proof of my employment in the application , contract , payslips etc , the thing is i do not work in the uk , i work in an eastern european non eu country on the basis of 9weeks at work and then 3 weeks at home , i do this all year round so im at home in the uk for a total of 3 months a year ( though not all at once), i have a house in the uk where my wife (african on spouse visa) and my own son ( uk from birth) live , and obviousely when im home i live there too , my question is , now that we have applied for my wifes son to join us in the uk with me as the sponsor will the embassy be able to refuse the application based on me not being "present and settled in the UK"

if so is there anything i can do to pre empt this

hi all

Can anyone advise
My stepsons application is in the BHC in Freetown
My wife and son where told last month to come back on 14th april for interview
The BHC phoned today and told her that she must come in to the embassy on friday 10th for a DNA test

anyone know how long the results take to get back to the ECO, will this delay their interview on the 14th ( just 4 days later)

Is it a good sign that they taking DNa
i read on the ECO guidance that dna tests should only be ordered when "related as claimed would be the only reason for refusal "

documents we provided for wifes son,s settlement visa

My passport copy Uk citizen (sponsor) certified
wifes passport (2 year spouse visa)
wifes and sons birth certif
my employment contract
my 6 mnth payslips
my 6 mnth bank statements
wifes 6 mnth payslips
wifes 6 mnth bank statements
8 mnths western union reciepts to sons carer in africa
8 mnths phone bills showing calls to africa
8 mnths skype phone records showin calls to africa
rental agreemant for home in uk

letter from childs teacher saying my wife calls her every 3 weeks to check on her sons progress in school

letter from childs carer to say my wife makes all important decisions concerning child

affadavit signed by father saying he has no contact with the child since birth (certified)

letter from landlord in uk saying no objection to child living in the home we rent

our application has been in for 1 month and the embassy have just taken a dna sample from my wife and her son to prove relationship

will post any progress
