Can i apply for Tier 1(general)??

Can i apply for Tier 1(general)??

Hi, all

I have a student Visa and now am staying London. I thought I can apply for Tier 1 (general) Visa and i've been preparing for it. but suddenly somebody told me that I am not able to ??!!! Can you tell me whether i can apply or not??
I came to England in July in 2007 and my course finished 8th march 2009.

'www.ukba.homeoffice.gov.uk' says

This option is only available for initial applications to the highly skilled worker category.

You may have difficulty obtaining points for earnings in the previous 15 months if you were studying during that time. You can, in certain circumstances, claim points for money earned before you started studying, even if that money was earned more than 15 months before your application under the highly skilled worker category. This is only for people entering the highly skilled worker category for the first time, and is not available if you are switching from the Highly Skilled Migrant Programme.

To qualify for the full-time study provision, you must:

be currently in full-time study; or  
have finished a full-time course within the 12 months before your application. 
If you are, or have been, a full-time student in those 12 months before your application, the time must:

be 12 consecutive months; and 
in the 15 months immediately before you make the application or the start of your full-time studies. 
If you have taken a number of full-time courses with gaps in between of less than 12 months, you can choose the start of the first full-time course and ask us to consider earnings from 12 of the 15 months immediately before the start of that course.

What reasons did this somebody provide? You can very well apply if you meet the eligibility criteria per Tier-1 Guidance notes. Also verify that you score 75+10+10 points per the points calculator available on UKBA website.

The reason is that

have finished a full-time course within the 12 months before your application.

She said that i've been here(England) over 12 months period so i don't fit the criteria. I got confused.

Anyway, You mean i can apply for Tier 1?!!! I have got 75 + 10 + 10 points. =)

I had quit previous job 31th May 2007, then came to london.
My course period is 2nd July 2007 - 8th March 2009.

Is this a problem??

There shouldn't be a problem as you finished your course less than 12 months ago - assuming you submit an application within the next 10 or 11 months.

No not at all. You can use your earnings immediately before your full time study to claim points. If you decide submit your application on say 8th April 2009 you can use salary for any 12 consecutive months between 8th May 2006 to 8th April 2008 (disregarding the full time study period).
