Settlement visa!!!

Post by qe22 » Sat Apr 04, 2009 6:35 pm

Good evening,

I was wondering if any one can help me, i need to find out whether if your appliction for indefnite leave to remian was refused in the uk, whether that means you would not be able to gain a settlement visa.

I have been with my finace for 3years now and we are going to nigeria to get married but i am worried that because i was refused indefnite leave to remain in the uk that it will have an effect on the outcome of my settlement visa here in the uk.

CAN ANYONE PLEASE ADVICE ME!

Can you say on what basis your application for ILR was made? And the reasons for refusal that were given?

settlement visa!!

Post by qe22 » Sat Apr 04, 2009 9:31 pm

It was based on the fact that I have been in this country for 12 yrs I came in on a student visa and then I over stayed due to circuntances that were happening in the north of nigeria which is where I am from! I'm an over stayer on my student visa! My lawyer said they refused my application because we contacted them while my application was in process which was back in feb! I am now planning to go marry me husband whom I have known for 5yrs but have been together for 3yrs! I'm still trying to get a travel documnet as my passport has run out! Is this enough info! I really need advice on this!

You applied for ILR after 12 years? But the rule is clearly 14 years, if some or all of the time in the UK was as an illegal. So the application was bound to fail.

The two of you now plan to get married in your country, after which you will apply for a spouse visa. As long as the evidence you present proves you have met all the rules .... such as financial, accommodation, evidence of contact ... your application will hopefully succeed.

qu22, quite simply you must complete the application form honestly, so as there are questions about previous applications, yes of course such applications must be mentioned.
