psw rejection on bases of not having name on bank statment.

hello everyone....i got psw visa rejected because of not having name on bank statment and i am gonna appeal against decision...has anyone come across similar situation when the person has appealed and won....

please help as i m not sure if appeal gonna work or not!!!i have spoked to many solicitor and they all have diffrent opinion...some say just re-apply again even though your current leave is expired...some say send it via 'one stop warning' where ur not apealling but writing again to homeoff telling them why they should give visa.....and lastly some are sayin i should appeal!!!!

VERY CONFUSED AS THIS IS LIFE OR DEATH SITUATION!!!! one wrong step can destroy your career!!

Please Help.

I think you have already asked this question and many people have already replied that you will WIN, as long as you can show them that you had £800 ALL THE TIME prior to applying for PSW in the SAME BANK ACCOUNT. You can not put a new application as your previous leave has already expired the only way for you is to appeal and i do believe that you will WIN. Try not to be panic and keep a cool head.

In the appeal (oral hearing) you will have a chnace to tell the judge that its a wrong refusal and you will provide the proof to him (which will be the same bank account orignal documents). I can not see why they would refuse you on your appeal.

I am afraid the way you are acting might get you in trouble so i would advise you to keep a cool head and pray for the best.

Agree with jack, a cool head is very important. Easier said than done but it is essential.

You should definitely appeal and you should win provided you had 800 at all times and your other documents are in order. Explain to the judge why the statement did not have your name (which you have not mentioned in your post). Get a letter from the bank (on its letterhead, signed and stamped) stating that you are a holder of that account and get them to issue fresh statements with your name on them if possible. But the letter and a proper explanation should be fine, the judges (or at least in my case) are eager to find out the truth. But you must keep a cool head and explain coherently.

You must also remember that mos of these cases are without precedent as the rules are new and often a lawyer will not be able to predict the outcome or will ask you to play it safe and start afresh. Which is why i represented myself and won. But in your case no reason you should appeal and not win.
