HSMP to WP to Tier 1 (HSMP) & the ILR judicial judgement

I had HSMP in Nov 05 and had to switch to WP during the Nov 06 changes as i couldnt get my renewal to the HO on time. Early last year i switched from WP to Tier 1 (HSMP). i currently have a visa on this Tier 1 (HSMP) due to expire june 2011.

Following the recent judgement on 6th April 2009, do i need to switch back to the original HSMP, before i can apply for ILR as this new ruling will allow me to qualify for ILR in Novemer this year (after 4yrs).

that is to say, if i stay on the new Tier 1 visa, can i apply for indefinite leave to remain come Nov 2009 (after 4yrs). Does being on the Tier 1 visa mean i qualify for ILR after 5 years even though i first joined the HSMP scheme on Nov 2005?

I honestly dont fancy sending my passport to the home office now as it takes ages for it to return.

Can someone pls advice
