Claming WTC and CTC

Married to brit. We have two kids, work part-time. She receives WTC and ChTC. My Application for Settlement Visa was refused because she claims this benefits. Please, advice me, how can my spouse in UK works a full time when she need to take care of the two kids alone and also goes to work. Is Child Care Maintanance also a public fund? We found out that coping alone with the children and also going to work a full time has sometimes result in sickness as a result of the workload on her. Please advice. I am able Bachelor Degree Holder.

Child Born Outside UK

Hi Mr John,

I really appreciate the way you throw light on some bothering issues. I read through and found out that this topic, (Child Birth Outside UK) relate to my circumstance. My wife a UK Citizen by Naturalization is also planning to have our Third Child in Nigeria, as she may find it difficult to cope alone, having two children, ages 4 and 2years at the moment.
Presently, my application for settlement was refused. Since I am still(Husband) a non British. What will our new child be?
In your replies to other, I found out that both parent were British but in my own case, my wife is a British and I am a Nigerian.
Appreciate your reply very soon.

Given your wife is British, by Naturalisation, she is deemed to be British otherwise than by descent. That therefore means that her children, born after her Naturalisation, will be British wherever born in the world.

However that is not the whole story. Her child born outside the UK will be British, but will be British by descent. That therefore means that whilst your child will have a total right to have a British passport, and to live in the UK, any children born to that child will only be British if born in the UK. That is, if your child has any children who are born outside the UK, then any such grandchildren of yours will not be British.

Whereas if your wife gives birth to her child in the UK, that child will be British otherwise than by descent, and thus any children born to that child will be British wherever born in the world.

The fact that you are not British makes no difference to any of the above.

Family Unification

What is the best way to unite with my family. I am married to a British. Presently Pregnant and with two kids. I have applied to British Embassy. My application for Settlement Visa was refused, because she claims Working Tax and Child Tax Credit. Each time I need to see my family, I had to travel to Germany on my Shengel Visa. She will have to travel down to Frankfurt with the two kids for just two weeks visit,(Hotel Bills and other expensis). I have been doing this since two years ago.

With her situation(pregnant), she may atimes not fit to travel to Frankfurt to meet me with the kids. That was why, we decided that she will need to come down to Nigeria to have the baby.

I must confess, We are finding it very tough due to this Family Seperation. I have to travell about 7hrs each time to see my family that will travel many hours on train trip from London Waterloo to Frankfurt.

Please, what is the best way out for me to unite with my family in UK? Is UK part of Europe? Immigration Procedures too dificult, even to their citizen. Please, Do you know any Agency or Body that can help with this my situation?

That is not a valid reason to refuse a spouse visa. Could you please tell us what the refusal notice said. Or if it really did say that, why didn't you appeal?
