Apply for ILR or FLR some help please

Hello,
Il keep this short and simple because i need some advice.

1. My wife got her spouse visa on 27/07/2007, she entered the UK on 9th October 2007 she was coming earlier but genuinally her mother got sick so i told her to stay.

2. Yeserterday that is 21/04/2009 i went to a OISC registered charity and they have told me because she entered the country after 28 days from the date the visa was issued she has to apply for FLR (extention for her visa) and she cannot apply for the ILR because she came into UK aftre 28 days from her visa being issued.

3. What is right and what is wrong because in the ILR Set(m) forms it does not mention about this all it says is that 28 days before your visa expires you need to apply thats all it says.

So what is the best thing to do because this means i need to apply for a another extension on her visa, and then for ILR?

Some straighforward help would be good as im already confused with what to do.
