Bringing baby back from India - born here!

Post by Sarah D » Tue Apr 21, 2009 3:23 pm

Hi all,

My sister-in-law and her husband are Indian, and they moved here to the UK on a working visa (along with their son) 3 years ago. She soon became pregnant and gave birth to her daughter here 2 years ago.

Subsequent to this her daughter has been in india as they were not in a position to be able to raise her here, however they are now and wish to bring her back. They have been told that the visa will cost £950, and that all manner of bank statements and pay slips etc as per in an adult visa application need to be produced - we think this is mad!!! For one thing she was born here, and how is it not just their RIGHT to bring there daughter here to be with them.

Does this sound right to anyone and does anyone have any knowledge of this at all? Any advice very gratefully received. As you can imagine my sister-in-law is in bits as she had thought that she could bring her over easily

If the parents did not have ILR at the time of the birth the child has no claim to British citizenship or any special treatment, hence they need a dependant visa for the child.
