Question concerning visa for spouse of a EU citizen

Question concerning visa for spouse of a EU citizen

Hello,

I am portuguese and my spouse is colombian. We are living in Germany. We married in Germany this month.
My spouse student visa will end in June. I would like to know if there is any problem to ask an family re-union visa (or something similar) here in Germany, and if it is a dificult process.

First of all, what are you planning to do in future in Germany? If you are a Portuguese national why would you have a 'spouse student visa' or any visa at all? I suppose you mean that your wife is on a visa right now.

Do you mean your spouse is on a student visa that is ending in June, as opposed to a 'spouse student visa' (never heard of it!) :?
Anyway, if he/she is on a student visa, and you are exercising your treaty rights in Germany (ie. working, studying, etc), then your spouse can apply to stay with you as a non-EU Family Member. Preferably, make the application before the student visa expires.

Actually, you may be required to do that within the first three months. See FreizügG/EU (German) for the legal situation in Germany.

Yes, I am the EU citizen and she has the student visa.

Ok, but what do you plan to support you and your wife's life there? As Rozen asked, will you be a student, worker, etc.?

I am at the moment working in germany. So I will just continue to work. My Spouse will try to find a job or spend half a year sharpg her german.

As a worker you will also have comprehensive sickness insurance. This means you are perfectly set up for application under EU regulations. Also the link I have sent you applies to you though there's a lot of legalese in there. I hope someone else familiar with the formalities and procedures in Germany can tell you what to do next. I suppose you already have confirmation of your legal status on a residence card.

I just married some days ago, so the only thing I have is the paper they gave us after the marriage at the standamt. That should prove we are married I guess.

That should be the official marriage certificate. I suppose you also have to register your wife with the local commune and then you'll have to get the residence card for her supposedly at the same place where you have got yours. Sorry, I can't give you more than some general advice as I am not familiar with the procedures in Germany. If you speak German you may be able to get much more information from a German speaking immigration forum.
