hi guys!
i recently posted a thread about my problems with getting a visa for my husband to come here.
I came across something that i dont know if it will help us or not so if anyone knows if we can use it to our advantage could you let us know....i read about EU treaty rights and the freedom of movement....???
We are going to get the help of a solicitor and we are also wondering if
the presence of a solicitor helps? We will probably just get him to give us a letter to send with the next application...do you think this will help...we
really do not know where to go next with this...we are just applying for a 3 month holiday visa so that we can have a wedding here and when his
visa expires i'll go back with him...do you think we should provide proof
of that aswell...i read somewhere on this board that proving the relationship after the marriage is almost as important as proving it before the marriage and we are hoping this is true as we dont have anything to
prove it before we got married...we are still apart and the stress is really getting to us. We were hoping, when we got married, that at this stage we would have a child or at least be expecting one! Seriously any advice anyone could give us would really be great

Thanks
xx

Mis just so you know - treaty rights are for when European citizens like yourself are living and working in another EU country......they are entitled to bring their family members with them!

Have a read read of the EU directive, if you were to live and work in another EU country it would be much easier for your spouse to be issued with a residence card!

Not to sure about Irish national law??? Where is your husband from?? You are Irish right?

Ok so I had a read of your other posts! If they refused your spouse visa I think it will be very difficult to be issued with a visitor visa! You would have to prove that he will go back to Turkey! Also he would have to provide bank statements to show how much money he has coming in etc etc etc.....Maybe you could go live there with him for a couple of months?? or try this -

Another way would be you move to another country within the EU apply for a visa for him to join you which should be issued free of charge and pretty quickly. You will have to show you are exercising treaty rights ie working or studying ! When he gets there he will be issued with a residence card usually within six months! After that it would be pretty easy to relocate to Ireland as you would have proof of relationship and he would be issued a visa in accordance with EU law! Not Irish national law!
