Please help, applied british passport in india

Post by anilkumarrai » Fri May 01, 2009 11:37 pm

I was born in uk on 13 3 1982,according to the rules i am british by birth,Have already applied Passport in british high commision in india with the following documents:
My full birth certificate
My Parents Passports(Indian)with PR status
My father employment details and his pension details
My whole education detail in india,

My parents lived in Uk Fron 1968 till 1990 and he was working, we moved back to India in 1990,my Parenjts had PR on my Bith year and still have it ,but its no concern as i was born b4 1983.
But now british high commision is asking for my vaccination detail of uk and my primary school records where i studied in uk just for 2 years (1988-1990),
Unfortunatly we dont have these records , i beleive my major document is Birth certificate and my mother passport where my name is there.
Now i am afraid that just because of this 2 document they ll refuse my passport application.
What in case they refuse ,can i re appeal??
I have contacted the school but they say that its too old record and there was no computers that time ,so its not possible to get those information.
my father has worked for 22 years in uk and we have already provided all the details.
Its question of my birth right,
Can they refuse and if they do how to re appeal,
Please help.

Yes they can refuse it, and as far as I am aware there is no right of appeal.

There is no law governing the issue of British passports, so Embassies can do whatever they like.

They are probably looking for proof of ID, such that you are the same person as on that birth certificate, but your local ID should be enough if the details are all the same.

If other records are lost, and the Embassy don't accept an explanation and refuse to issue you with a passport, you have a huge problem.

Have you got an Indian passport? If so, you could apply for a Right of Abode stamp in your Indian passport - there are formal rules and a right to appeal if refused.

local proof

Post by anilkumarrai » Sun May 03, 2009 2:03 am

hi jaj thanks for reply , yes we have provided them my local indian id such as driving licence and my qualification detais , admit card of university etc,,and all the documents has my parents name as well , it clearly proof that i am their daughter, just because of that 2 years in uk in primary school documents which we dont have, they cant overlook my all details of life in india , i was just 7 years old when i left uk , so they should also understand that my major proof of identity will be from my life in india, and all the documents from india r of government.
please advice

Hi
Did you read post #2? There is some useful information in it, especially the last paragraph.

If you wish to discuss with an immigration solicitor regarding possible court action if they refuse your application, try http://www.lauradevine.com and http://www.plsimon.co.uk

DNA test

Post by anilkumarrai » Mon May 04, 2009 7:15 pm

Hi jaj
i have contacted british high commission again that its impossible to get my primary school record and my vaccination details in uk.
Any way we have provided them our local indian id like certificates and my driving license .
But now they r asking me n my dad to do DNA test , i think its better for us ,This test will definetly proof that he is my dad and i am the same person who was born in uk.
What do u think?then they ll have no reason to refuse.
